Is your contract in your best interests? Find out at Trucking Australia 2016.

Congratulations! You’ve won the contract! But how can you make sure the contract complies with the law and protects your interests?



At Trucking Australia 2016, Cooper Grace Ward special counsel Gillian Bristow will lead a masterclass about what trucking businesses need to look for as they review contracts.



The masterclass will feature the launch of the ATA’s new contract checklist. Using the checklist, delegates will work through a hypothetical industry contract, identify potential problems and find out how to fix them. The masterclass will cover:

  • how to make sure contracts comply with the 2014 and forthcoming 2016 Road Safety Remuneration Orders, whether you are a hirer or a contractor
  • the Heavy Vehicle National Law contract requirements
  • unfair terms in standard form contracts
  • liability for consequential loss, payments terms and more.

ATA Chief Executive Christopher Melham said the masterclass and checklist responded to the industry’s growing concerns about contract issues.



“Last year, our delegates said trucking businesses were feeling pressured into accepting risks that should belong to customers, signing contracts with flawed chain of responsibility requirements, or accepting payment terms they couldn’t support,” Mr Melham said.



“The ATA has listened and is taking action, with this masterclass and our contract checklist. They will cover the key contract issues facing trucking businesses – including how to make sure contracts comply with the 2014 and 2016 Road Safety Remuneration Orders.



“The ATA is not an industrial relations organisation, but our members have agreed that any discussion about contracts has got to include the requirements of the orders. Whether the orders are a good thing or not is a separate issue,” he said.



The full version of the contract checklist will be available exclusively to members of ATA member associations and Trucking Australia 2016 delegates. A preview of the RSRO section of the checklist will be available exclusively to members of ATA member associations and Trucking Australia 2016 delegates in mid-March.



Trucking Australia 2016 will be held at the Sea World Resort on the Gold Coast from Thursday 23 to Saturday 25 June 2016. Full delegate registration is just $495 (inc GST). On-site accommodation is available at the 4½ star Sea World Resort, with special delegate rates starting from $169 per room per night.
